The High court has suspended the Kimwarer and Arror dams graft case against former Finance Cabinet Secretary Henry Rotich and other suspects.
The suspension comes after an application by one of the suspects in the case Richard Malebe, who alleged that his rights were violated when he was arrested and charged alongside former CS Rotich.
Malebe was arrested after it was alleged to be a director of CMC di Ravenna, the firm that was to fund the dams project.
Chief Magistrate Douglas Ogoti made the announcement of the suspension on Monday with Rotich and former Principal Secretary Kamau Thugge being present in court.
The court has now allowed the Director of Public Prosecutions to have the case mentioned on March 26, 2020. Prosecutor Taib Ali Taib asked the magistrate to issue a warrant of arrest for some of the suspects who have never appeared in court.
Henry Rotich and other top government officials are accused of bending the rules and misleading the public about the state of national finances.
Italian firm CMC Di Ravenna was to fund the Arror and Kimwarer dams project but was later found to be bankrupt. Despite this discovery, the National Treasury and the Kerio Valley Development Authority (KVDA) went ahead to spend Ksh 20.5 billion of taxpayer’s money on ghost projects.
